“I’ll kill you bitch!..”
April 24, 2006 at 18.20 of Kyiv time witnessed an offbeat event which happened in the territory of the automotive cooperative “Kooperatyvna-6”. As soon as the member of the management of this automotive cooperative Valerii Hryhorovych Laievskyi walked up to the guardsman of the cooperative territory and asked: “How things are going on?”, Yurii Volodymyrovych Petrenko, the former head of this cooperative, flung out of black Skoda car with tinted windows, parked nearby, and ran to Laievskyi. Everything happed in a wink of an eye. Petrenko pulled a gun out the inside pocket in his jacket and put it to Laievskyi’s right temple and broke forth into explanations for the dumbfounded member of the management, what was the reason of his actions: “You do not know with whom you deal! I’ll show who Petrenko is! I’ll kill you bitch!…”
However, Petrenko failed to make his threats true, because of members of the automotive cooperative passing by, who made a fuss. With the words: “shut up, bitch, I’ll kill you too!” addressed to the guardsman, Petrenko withdrew to his car and drove away.
Having calmed down a little, Laievskyi called the police, which swiftly arrived at 19.50 of Kyiv time. Nevertheless, Valerii Hryhorovych was able to leave the territory of the cooperative only at 23.30 escorted by his friends, because Petrenko drove up to the gates two times more, and Laievskyi called 02 two times again.
Expectedly, the police assigned the local inspector to hunt down the conflict.
How did the member of the management of the automotive cooperative “queer pitch” so much for the former head?
The Cooperative of Personal Gain
A little more than a year ago, on May 4, 2005 in particular, an extraordinary meeting of the management of automotive cooperative “Kooperatyvna-6” was held, during which V.H. Laievskyi, the head of the cooperative’s checkup committee, took the floor with a report. His report on the results of checking up the performance of Yu.V.Petrenko, the head of the management board, cast the present people down. Within several minutes he disclosed everything about the shadow performance led by the cooperative’s head. Now let’s give the floor to the head of the checkup committee.
“Our cooperative consists of two grounds located at the same address: ground No. 1 – Palladina avenue 13/1. Ground No. 2 is the corner of Irpinska street and the said avenue. The grounds where the automobiles are parked are two-levelled: underground and above-ground.
Within the period from 1997 till the present time, the cooperative head Yu.V.Petrenko with is assistants V.D.Koval and A. Shumskyi turned the cooperative into a company for personal gain. They gained at the expense of hiding the cooperative’s true yield, in other words, robbing the state and the cooperative’s members. Furthermore, rules for safe operation of buildings and constructions are blatantly violated, as well as fire and environmental safety rules, the environment is being harmed.
Without approval of the management and the members of the cooperative, Yu.Petrenko disassembled ventilation of the underground parking on the ground No. 1. Having removed a part of ventilation system, he expanded the useful area in some garages. Then the head crippled the fire-fighting system after its partial disassembly in 2000 and self-willed gave the released premise to lease without any lease agreement concluded. The guard’s room he uses as an overnight premise, giving it to lease to the builders.
The territory of the parking, traffic way and constructions in the territory have never been repaired. Underground parking has turned into damp cellars. Yu. Petrenko parks his personal car on the reserve exit road from the underground parking, thus exposing the property of more than 250 members of the cooperative to danger in case of fire.
He always underpays his subordinates – the hires employees. These underpayments and extra cash (amounting to approximately 5 thousand hrynias per month) receipts from the so-called guests were used by Yu.Petrenko to purchase cars, to build tyre fitting, carwash and two-storied shop in the territory allotted to the cooperative. The management knows absolutely nothing about the results of Yu.Petrenko’s financial activity. In any case, instead of anticipated reduction of charge for the personal place for parking, members of the garage cooperative were forced to pay more. According to our calculations, Yu.Petrenko owes the cooperative a sum of nearly 600 thousand hryvnias. This sum is the yield concealed by him and gained from the cooperative’s performance during the last 8 years. He also caused loss totalling 200 thousand hryvnias to the cooperative due to disassembly of ventilation and deactivation of the fire-fighting system.
We checked the actual presence of automobiles on the grounds several times. Each time we check up, we revealed a great number of unaccounted cars of non-members of the cooperative (20 and more cars), parking of which was not paid to the pay-box of the cooperative. Every month more than 20 people pay for their cars 120 hryvnias, but give this money to Yu.Petrenko personally or via the guardsmen.
When Yu.Petrenko again decided to raise operating fees from each parking place from 20 to 25 hryvnias per month, though the number of cars on the cooperative’s ground increased twofold, at that very moment a question about checking up the head’s economic performance was raised. Preliminary results of the checkup were showing a range of howling breaches, expressed in the head’s abuse of his authority. For example, Yu.Petrenko solely accepted new members of the cooperative. He did not conclude an agreement with SEM & K company for payment of the cooperative’s services.
Having a salary totalling 500 hryvnias, he built a tyre fitting, a carwash, a shop, being off the balance sheet of the cooperative, bought two new cars: for him and for his wife. However, the operation of premises, power- and water-supply to them, and the sewerage system are maintained at the cooperative’s expense…”
Three Faces of the Same Person
The head of the checkup committee continued with his report. It was found out that Yu.Petrenko, without approval of the management, concluded an agreement with the private company BOB for construction of metal shed on the ground No. 2. For some reason this agreement was approved by the deputy head of Sviatoshyn district administration P.Tsynyk, which, according the reporter, “is a novelty in relations of entrepreneurs in the territory of Ukraine”.
Having concluded the agreement, Yu.Petrenko promptly made a prepayment and then a complete discharge for the shed with money, the origin of which is unknown. And, in order not to stop on what has already been achieved, the head simultaneously transferred a part of the cooperative’s property into indefinite lease to the private company BOB. And here it was found out, that the director and the accountant of the private company BOB is … Petrenko Yurii Volodymyrovych, being the chairman of the “Kooperatvna-6” cooperative’s management!
Indignant members of the cooperative applied to the administration of Sviatoshyn district. It turned out that Yu.Petrenko submitted to the regulating body “faked acts, resolutions of the meetings and the cooperative management, and commission for checking up the economic performance of the cooperative”.
According to the head of the checkup committee, in the beginning of summer 2004, the tax inspection audited the cooperative’s performance. Yu.Petrenko did not report about the results of that audit to anyone. Members of the management incidentally got to know that Yu.Petrenko was fined by the fiscal authority. However, the head imposed the fine for his miscalculations on the members of the cooperative, having increased their monthly charges for 7 hryvnias.
“On April 27, 2005 the members of the management, the head of the checkup committee and initiative group consisting of the cooperative members again attempted to clean up the performance led by the head of the cooperative management Yu.V.Petrenko. He was suggested to summon a general meeting of the cooperative and to account for the work done with the consideration of those notices given to him in writing by the head of the checkup committee on 15.04.2005. Yu.V.Petrenko did nothing of what was mentioned above”.
In response to the neglect exhibited by the head towards the demands of the associates, the meeting was gathered. And, expectedly, after short speeches and debates, the management decided “for grave breach of work … to dismiss Yu.V.Petrenko from the position of the head of the automotive cooperative “Kooperatyvna-6”.
Approved Personally by the Head of the District Administration!
Now the former chairman of the management litigates with the members of the management. And, at the same time, sells places in his former holding. Thus, for example, on the 15th of April of this year initiation fees for the new member of the collective totalling 1250 hryvnias were paid by E.Yu.Kostiukov, though, according to the newly elected management, he is not even a member of the cooperative!
And, irrespective of all legal proceedings, Yu.Petrenko delivers another “blow” to the cooperators: as it turned out, recently he has been approved to hold the position of the cooperative’s head by … the head of Sviatoshyn District Administration V.O. Mazepa. And this fact is witnessed by the respective document:
“Sviatoshyn District Administration in Kyiv city considered an application (Ref. No. 3312л dated 05.05.2006) on illegal actions of the cooperative members made at the meeting held on 12.04.2006 and their consequences concerning disorder of cooperative’s management and operation.
According to it. 35 of the Cooperative Charter, Sviatoshyn District Administration in Kyiv city annuls the resolution declared at the meeting of the cooperative members on 12.04.2006.
Responsibilities of the chairman of the management concerning resolution of matters relating to the “Kooperatyvna-6” cooperative’s management and operation shall be borne by Yu.V.Petrenko until the settlement of the mentioned issue according to the procedure stipulated by the Charter.
Actions made by the persons, being the members of the cooperative and who faked the resolution of the meeting of the cooperative members dated 12.04.2006, as well as amendments made to the statutory documents of the cooperative shall be considered by the law-enforcement authorities.

P.S. A sound reason to feel glad about the efficiency of Sviatoshyn District Administration: as soon as the person applied, on 05.05.2006, he got the resolution the same day года! If only all applications were as lucky as this one!
